Court of Appeals Issues Favorable Ruling for Holmquist + Gardiner Client (Published Opinion)

Congratulations to Holmquist + Gardiner PLLC attorneys Hamilton H. Gardiner and Michelle Fze Chong So on the recent positive ruling in the Court of Appeals of Washington, Division Two. This is a decision in favor of our client and a published opinion for the firm!

The Court of Appeals held that the Appellant’s knowledge at the time of purchase that two undeveloped parcels were landlocked did not bar him from seeking to condemn an easement under RCW 8.24.010, and such knowledge alone should not have been the basis for summary judgment against him. The Court reversed the order granting summary judgment in favor of the Respondents and remanded for further proceedings. Nayeri v. Eagle Hardware & Garden, Inc., 2024 Wash. App. LEXIS 860
